The Hataman-Dumarpa Anti-Discrimination Bill

Rep. Mujiv Hataman of AMIN Party List and Rep. Faysah RPM Dumarpa of Lanao del Sur had filed two different bills on anti-Discrimination. Their bills are now being consolidated into one.

A RESOLUTION DIRECTING THE HOUSE COMMITTEE ON MUSLIM AFFAIRS TO CONDUCT AN INVESTIGATION IN AID OF LEGISLATION ON THE RAMPANT INCIDENT OF "HULIDAP" MANIFESTED BY ILLEGAL ARREST, ARBITRARY DETENTION, AND PLANTING OF EVIDENCE RESULTING TO EXTORTION, AGAINST MUSLIMS ALLEGEDLY COMMITTED BY UNSCRUPULOUS ELEMENTS OR SCALAWAGS OF THE PHILIPPINE NATIONAL POLICE (PNP) OR OTHER LAW ENFORCEMENT AGENCIES
   WHEREAS, the armed conflict in the southernmost part of the country caused the migration (admittedly involuntary) of Muslims to the National Capital Region and its nearby cities or provinces for greater economic opportunities;

    WHEREAS, the Office on Muslim Affairs (OMA) approximately estimated that there are 1.6 million Muslims in the NCR, comprising mainly of businessmen, students and professionals. As of year 2000, there are approximately 3,854,315 Muslims in the entire country;
    
    WHEREAS, lamentably, the Muslim ghettoes in the National Capital Region and its nearby cities or provinces face more intricacies in life, experiencing several prejudices, discrimination, and callousness from the community they presently evolve;

WHEREAS, the prevalent incident of discrimination and harassments experienced by Muslims whether in the National Capital Region or in other parts of the country is the so-called "HULIDAP" scheme committed by scalawags of the Philippine National Police or other law enforcement agencies. "HULIDAP" is manifested by illegal arrest, arbitrary detention and planting of evidence resulting to extortion;    

    WHEREAS, the record of the Office on Muslim Affairs Metro Manila Regional Office shows that from December 2005 to date, thirty (30) individuals executed formal complaints and affidavits against scalawag members of the District Anti-Illegal Drugs Division (DAIDD) in Camp Karingal in Quezon City, and the Quezon City Anti-Drug Abuse Council (QCADAC). These complaints comprise only a percentage of the pervasiveness of "hulidap", a scheme pursued by public officers that brought fear and anxiety to the lives of the Filipino Muslims in the different parts of the country;

WHEREAS, some of the victims of "hulidap", who were courageous notwithstanding continued harassments, filed their complaints with the Internal Affairs Services of the Philippine National Police and the Office of the Ombudsman for administrative and criminal case. However, most of the victims who fear for their personal safety and for their families are opted to inhibit from pursuing their complaints;

NOW THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED, that the House Committee on Muslim Affairs conduct an investigation in aid of legislation on the alleged rampant incident of "Hulidap" manifested by illegal arrest, arbitrary detention, and planting of evidence resulting to extortion, against Muslims whether in the National Capital Region or in other parts of the country, allegedly committed by unscrupulous elements or scalawags of the Philippine National Police.
