ABS-CBN News Online and Philstar.com reported that Anak Mindanao (AMIN) Party List Rep. Mujiv Hataman, was charged by the PNP as one of the "Principals by Inducement" in the Batasan Blast case.
Police defined "principal by inducement" as a person who does not take a direct part in the execution of a crime, but induced or forced another to commit it.
The charges against Rep. Hataman were based on the testimonies of arrested suspects Ikram Indama and former mayor Harijun Jamiri of Tuburan, Basilan, who were earlier charged with murder and frustrated murder along with two other arrested suspects, Kahidar Awnal and Adham Kusain.
However, during (November 29, 2007) Thursday’s preliminary investigation proceeding (at the DOJ), three of the suspects refused to affirm their earlier statements that were supposedly executed in the presence of a lawyer of their choice and alleged that the statements were in fact involuntarily executed.
Those who refused to affirm their affidavits were former Tuburan mayor Jamiri, Indama and Awnal.

MINDANAO lawmakers yesterday took up the cudgels for Anak Mindanao Rep. Mujiv Hataman, who had been tagged as one of the masterminds in the Batasang Pambansa bombing. In a joint statement, Deputy Speaker Simeon Datumanong of Maguindanao, Lanao del Sur Rep. Pangalian Balindong, Tawi -Tawi Rep. Nur Jaafar and Sulu Representatives Yusop Jikiri and Munir Arbison said Hataman is not capable of plotting the blast on Nov. 13 that killed Rep. Wahab Akbar. The lawmakers doubted the statement of captured suspects implicating Hataman and former Rep. Jerry Salapuddin the bombing. Balindong urged the Philippine National Police to widen the scope of its investigation after police officials said both Hataman and Salappudin will also be charged. “It is highly improbable that he (Hataman) has anything to do with the incident. He even voluntarily offered himself for investigation,” Balindong said. Datumanong on the other hand said it is hard to believe the statement of the suspects since a Muslim cannot harm another Muslim. “We already lost a Muslim colleague in the said incident. This imputation made by the PNP of another colleague as mastermind is so much harder for us to accept, considering that Mujiv is known to us to be incapable of performing such act,” Datumanong said. “It is unfair on the part of Mujiv and his family to be implicated in the incident, if the same would later be established to be unfounded,” Jaafar said. He asked the PNP to thoroughly investigate the incident and not totally rely on the statement of arrested suspects. Jikiri said Hataman is a good man while Arbison described him as a good friend and an advocate of human rights, peace and development in Mindanao. Hataman reiterated that he had nothing to do with the bombing but said he is preparing himself for the worse scenario. “Malinis ang aking konsensiya, siguradong-sigurado ako sa aking sarili. Ang tanging apela ko lang sa CIDG, mag dahan-dahan naman sila sa pag-iimbestiga. Hindi sila dapat naniniwala sa kwento-kwento. Nakahanda ako sa anumang pwedeng mangyari,” Hataman said. |
