DOJ Resolution dismisses complaint against Hataman
Rep.Mujiv S. Hataman
“Finally, we are vindicated..”
These were the words of relief from Anak Mindanao Representative Mujiv S. Hataman when the Department of Justice came out with the Resolution finding no probable cause to include him in the information in Criminal Case No. Q-07 149982 filed by the PNP-CIDG-NCR-CIDU and other complainants.

“We have always believed that God does not side with lies, and the truth will eventually come out and vindicate us. I thank the Almighty for this serving of justice to me and everyone who believed and stood behind me,” Hataman said.

The case involved the November 13, 2007 bombing of the Southwing Lobby of the House of Representatives which caused the death of at least 6 people, including Congressman Wahab Akbar of the lone district of Basilan.

Based on the theory that said bombing was politically motivated, Congressman Hataman, who was alleged to be a political rival of the slain solon was suspected to be one of the masterminds in what the CIDG claimed to be a conspiracy behind the bombing.

In at least two privilege speeches delivered by Congressman Hataman in the House of Representatives, he vehemently denied involvement in the bombing, saying he did not have the motive, nor the means to do such terrorist act. Many of his fellow Congressmen stood behind Rep. Hataman, believing in his innocence and vouching for his character.

However, the CIDG proceeded to include Cong. Hataman in their complaint filed before DOJ, on the basis of sworn statements made by suspect turned witness Ikram Indama and former Tuburan mayor Hajarun Jamiri, who later recanted on the contention that his statements were taken under duress.

In a 21-page resolution, the Department of Justice stated, “There can be no doubt that conspiracy exists as to the other respondents as shown by their concerted acts based on the circumstances that attend the commission of the crime. However, with respect to respondent Mujiv Hataman and Hadjiman Hataman-Salliman, their participation as conspirators in the grand scheme is unstable….. Apart from the statements implicating Mujiv Hataman and Hadjiman Hataman-Salliman, no other evidence was presented to sufficiently establish their involvement in the crime..”

The Resolution further decided that “…charge against respondents Mujiv Hataman and Hadjiman Hataman Salliman be DISMISSED for insufficiency of evidence.”
